Below is a copy of the English Translation of a letter I received in March of 2003 from the IPN (Polish Institute of National Remembrance) in respone to my inquiry regarding the availability of records of the trial of Sigmund Kozlowski. It appears that records of the trial were destroyed in 1989. So far there is no factual information as to by who these documents were destroyed and why.

 

In reply to your letter of January 3, 2003, regarding finding documents
concerning your relation Poltiel Lopata, we regret to inform you that such
documents are not found in the archival collection of the Biuro
Udostepniania i Archiwizacji Dokumentow Instytutu Pamieci Narodowej w
Bialymstoku. However, we can report that Zygmunt Kozlowski, a policeman
from Zabludow, was arrested twice for cooperation with the Germans - on
April 27, 1946, and on March 1, 1947. Subsequently, on November 12, 1947,
he was sentenced to a punishment of 8 months in prison. The records of
this matter were destroyed in 1989.

However, in our archival collection there are materials concerning the
crimes committed by German gendarmes from Zabludow. The records with
numbers IPN Bi 1/921 and IPN Bi 1/922 (formerly numbers S.87/68) were
created by the District Commission for Prosecution of Nazi Crimes in
Poland. They concern war crimes such as murder and the pacification of
villages which were committed against Polish citizens, including citizens
of Jewish ethnicity, by the gendarmes from the sentry post in Zabludow
during 1941-1944. The Commission offered a proposal to prosecute the
functional and rank-and-file gendarmes, as well as other
functionaries of the German occupational power who, driven by racial
hatred, gave orders condemning the residents of Zabludow and neighboring
villages to death. In Poland the investigation lasted from 1968 to 1973.
Then in 1973, the matter was referred to the Zentrale Stelle der
Landesjustizverwaltungew in Ludwigsburg in Germany (address: Zentrale
Stelle der Landesjustizverwaltungen, Schorndorfer Str. 58, 71638
Ludwigsburg, Germany), with a request to initiate penal processes against
the gendarmes and funtionaries of the German administration in Zabludow.
